REPEAL PORTION OF EXECUTIVE ORDER NO. 854 RELATIVE TO THE REVOCATION OF PRESIDENTIAL PROCLAMATION NO. 704
A. THERE IS NO BASIS FOR THE REVOCATION OF PROCLAMATION NO. 704
1. The DENR Region IV-A Report re: proposed revocation of Proclamation No. 704., dated November 26, 2009, contain false, misleading and inaccurate assessment of the situation.
a. There is not a single structure or establishment that was “washed out” within the area covered by Proclamation No. 704.
The area being presented and referred to as totally submerged and washed out by typhoon Ondoy is a community called Purok 8 of Lupang Arenda. PUROK 8, although part of Lupang Arenda, IS NOT PART OF THE PROCLAIMED SITE. Said community is now totally abandoned.
b. While it is maybe true that the proclaimed site lies below the 12.5 mean low water level set by Laguna Lake Development Authority (LLDA), it is not this situation that caused the waist-high flooding within the proclaimed site during the typhoon Ondoy.
The whole proclaimed site is protected by the Metro Manila Flood Control Project (Lakeshore dike). The realignment of the dike to protect the whole proclaimed site was provided through the Memorandum of Agreement of 2003 entered into and by the National Agencies, which the office of the President was well aware of and duly approved.
The real cause of the flooding was due to the unfinished portion of the dike near the Pumping station where the lake water passed through.
The flooding was further aggravated by the negligence on the part of the agency-in-charge in closing the 4 manually-operated gate valves at the height of the typhoon.
With the completion of the Metro Manila Flood Control Project, the whole area of Proclamation 704 would no longer be susceptible to flooding.
2. The third premise stated in the Executive Order NO. 854 is not true.
a. EO 854 third premise stated, “Whereas, there are about 100,000 families presently living within and outside the proclaimed sites which obstruct the flow of water along the Napindan channel and the Manggahan floodway”
b. Again, the Purok 8 is the one clearly and visibly obstructing the flow of water along the Napindan channel, and not the area covered and within the Proclamation No. 704.
3. There was no adequate consultation with the concerned LGU’s and stakeholders.
a. There was clearly an attempt on the part of the government not to disclose the revocation.
b. The concerned LGUs are in the position to verify and validate the objective situation of the proclaimed site.
4. The recommendation lack technical evaluation to support and validate the findings of DENR.
a. The creation of technical working group to conduct further investigation, technical evaluation and submission of comprehensive report was correctly suggested by Undersecretary for staff bureaus Manuel Gerochi on December 4, 2009. However, the suggestion was apparently rejected.
B. The revocation of Proclamation No. 704 will render useless all past efforts and resources spent both by the government and the occupants, and will erode the confidence and thrust of the people in the government’s policy and programs.
1. Aside from the P2B fund for the implementation of Metro Manila Flood Control Project, the government had to secure additional fund for the realignment of the dike provided by the Memorandum of Agreement of 2003 just to protect the whole areas covered by Proclamation N0. 704.
The realignment paved the way for implementing various self-help development projects by the occupants of Proclamation No. 704 and infusion of local government units fund for various infrastructure projects in the proclaimed site.
2. The signing of the Memorandum of agreement built and strengthened the thrust and confidence of the stakeholders in the government’s policies and projects. The revocation of the proclamation will certainly cause the erosion of their trust.
C. The revocation and the ensuing relocation program will be expensive and only create bigger social problem
1. The government will be spending P12B just to relocate the 60,000 families. Said fund can be effectively use for other projects of the government.
2. This will only disrupt the lives of the 60,000 affected families who have fully adjusted and living a normal life in the proclaimed site.
3. The scarcity of available relocation sites will only aggravate the problem.
D. It is more practical and economical for the government to implement solutions to the problems affecting the viability of the proclaimed site as socialized housing project.
1. Increasing the height of the dike to 2 meters.
2. Improving the drainage system within the proclaimed site.

LUPANG ARENDA RESIDENTS TROOPED TO MALACAÑANG CALLING FOR REJECTION OF THE PROPOSED REVOCATION OF PROC. 704
Thousands of residents of Lupang Arenda trooped Malacanang this morning to show their objection to the proposed revocation of Proclamation 704. The said proclamation was issued by President Fidel Ramos on November 28, 1995 and opened some 80 hectares of public lands in protected wetlands to accommodate the growing number of informal settlers along Pasig river and less privileges families of Taytay, Rizal. But President Gloria Macapagal-Arroyo is preparing to revoke Proclamation 704 coming from wrong information from DENR based on inaccurate information and mis-appreciation of the objective situation of the proclaimed site. The recommendation was primarily based on the situation of a community outside of the proclaimed site and portrayed as the whole situation of the families within proclamation 704.
According to Recto M. Bagay, president of Arenda Urban Poor Federation, Inc. (AUPFI), the aggravated flooding experienced within the proclaimed site was due to the negligence of the agency implementing and maintaining the Metro Manila Flood Control Project, based on the Memorandum of Agreement of 2003 signed and entered into by different national agencies including Department of Environment and Natural Resources (DENR) and Laguna Lake Development Authority (LLDA).
Proclamation 704 being situated at 12.5 m. el. does not affect the viability of the proclamation as a housing project if only the Metro Manila Flood Control Project was fully implemented and properly maintained by the concerned agency.
They said they will continue their strong opposition to the proposed revocation of Proclamation 704 until proper consultation, negotiation and lasting solution will be met. They are appealing to President Gloria Macapagal-Arroyo to defer the signing of the revocation and conduct re-evaluation and consultation among the stakeholders.

MGA TAGA-LUPANG ARENDA NAGTUNGO SA MALACAÑANG PARA TUTULAN ANG REBOKASYON NG PROCLAMATION 704
Libu-libong residente ng Lupang Arenda ang tumungo sa Malacañang kaninang umaga upang ipakita ang kanilang malawakang pagtutol sa panukala ng Malacañang na ipawalang-bisa ang Proklamasyon 704. Ang nasabing proklamasyon ay inisyu ni dating Pangulong Fidel Ramos noong Nobyembre 28, 1995 at nagbukas ng may 80 ektaryang lupain para gawing pabahay ng mga maralita na nasa Ilog Pasig at mga mahihirap mula sa Taytay, Rizal. Ngunit sa ngayon, inihahanda na ni Pangulong Arroyo na ipawalang-bisa ang proklamasyong ito batay sa mga maling ulat ng DENR kung saan tinukoy nito na ang pagbaha ay pumapatungkol sa buong Lupang Arenda gayong ang Purok 8 na labas sa nasabing proklamasyon ang siyang iniuulat sa mga radio at telebisyon. Hindi ito ang buong Lupang Arenda.
Ayon kay Recto M. Bagay, pangulo ng Arenda Urban Poor Federation, Inc. (AUPFI), walang na-washed out na mga bahay at establisimyento sa mga lugar na sakop ng proklamasyon noong kasagsagan ng bagyong Ondoy. Hindi dapat isisi ang naganap na pagbaha noong panahon ni Ondoy sa mga maralita, kundi sa kapabayaan ng mga ahensyang nakatalaga sa pagpapatupad sa Metro Manila Flood Control Project, na batay sa Memorandum of Agreement ng 2003 na nilagdaan at pinasok ng iba’t ibang pambansang ahensya, kasama na ang DENR at Laguna Lake Development Authority (LLDA).
Nananawagan sila kay Pangulong Gloria Arroyo na huwag lagdaan ang rebokasyon at magsagawa muna ng reebalwasyon at konsultasyon sa mga residenteng sakop ng proklamasyon.
Ayon pa sa kanila, magpapatuloy ang kanilang mga pagkilos laban sa panukalang rebokasyon ng Proklamasyon 704 hanggang sa magkaroon ng nararapat na konsultasyon sa mismong mga residenteng sakop ng proklamasyon, may maayos na negosasyon, at makamit ang isang pangmatagalang solusyon sa kanilang kasiguraduhan sa paninirahan.

IPAGTANGGOL ANG ATING KARAPATAN SA PANINIRAHAN!
Mga kaibigan, kasama, kapatid sa Lupang Arenda,
Tumira tayo dito sa Lupang Arenda sa bisa ng Proklamasyon 704 na nilagdaan ni dating Pangulong Ramos noong Nobyembre 28, 1995 bilang bahagi ng programang pabahay para sa mahihirap. Ito ang pinanghahawakan natin sa ating kasiguraduhan sa paninirahan dito sa Lupang Arenda. Ngunit ito’y pinangangambahang mawala nang inatas ni Pangulong Arroyo sa HUDCC na gumawa ng draft na nagpapawalang-bisa sa Proclamation 704. Ito’y naganap sa pulong ng mga myembro ng gabinete, kasama si PGMA, sa Loboc, Bohol, noong Nobyembre 16, 2009.
Dahil dito, sumulat agad ang HUDCC sa pamamagitan ni Usec. Lucille P. Ortile kay Department of Environment and Natural Resources (DENR) Secretary Lito Atienza na magsagawa ng kinakailangang ebalwasyon at maghanda ng investigative report para sa mungkahing rebokasyon ng Proclamation 704. Nobyembre 22, 2009, ipinalabas sa telebisyon na umano’y baha pa dulot ng bagyong Ondoy ngunit ang pinakita ay ang Purok 8 na bahagi ng Lawa ng Laguna na hindi naman bahagi ng PP704. Subalit ang lugar na hindi sakop ng Proklamasyon 704 ang ginawang basehan ng DENR-CALABARZON upang irekomenda sa pangulo ang pagpapawalang bisa sa nabanggit na Proklamasyon gamit ang mga maling ulat ng Media na ang tinutukoy sa kanilang ulat sa telebisyon ay hindi naman bahagi o sakop ng Proklamasyon 704.
Naniniwala kaming ang rekomendasyon para i-revoke ang proklamasyong ito ay batay sa maling impormasyong nakuha nila at kawalang pagpapahalaga sa sitwasyon sa Lupang Arenda. Pagkat ang lugar na sinasabing binabaha na ginawang batayan ng pag-revoke sa PP704 ay labas sa nasabing proklamasyon at hindi naman naglalarawan sa kabuuang sitwasyon ng mga pamilyang sakop ng 704.
Hindi dapat isisi ang naganap na pagbaha noong panahon ni Ondoy sa mga maralita, kundi sa kapabayaan ng mga ahensyang nakatalaga sa pagpapatupad sa Metro Manila Flood Control Project, na batay sa Memorandum of Agreement ng 2003 na nilagdaan at pinasok ng iba’t ibang pambansang ahensya, kasama na ang DENR at Laguna Lake Development Authority (LLDA).
Mga kababayan sa Lupang Arenda, halina’t tutulan natin ang planong rebokasyon ng Proclamation 704 dahil mali ang kanilang mga batayan. Maling-mali ang rekomendasyon ng DENR kay PGMA, pagkat pawang mga di sakop ng proklamasyon ang itinuturong na-wash out daw, gayong alam ng mga tagarito sa Lupang Arenda na wala namang na-washout na establismyento at mga kabahayang sakop ng proklamasyon.
Kung hindi tayo kikilos at magkakaisa, mabubulabog ang ating tahimik na pamumuhay. Kung tutunganga lang tayo, mawawalan tayo ng tahanan ng walang kalaban-laban. Dapat nating ipaglaban ang ating karapatan sa katiyakan sa paninirahan.
Halina’t magkaisa tayo at magsama-sama upang ipaglaban ang ating kinabukasan at karapatan ng ating pamilya. Magsabit tayo ng mga streamer sa ating mga bahay na nagsasaad na tinututulan natin ang rebokasyon ng Proklamasyon 704. Lumagda tayo sa signature campaign na pinangungunahan ng ating pederasyon, ang AUPFI, bilang patunay ng ating pagtutol sa rebokasyon ng Proklamasyon 704. Magmasid tayo’t laging makipag-ugnayan sa ating mga lider. Alamin nating mabuti ang isyung ito.
Napamahal na sa atin ang Lupang Arenda na siyang naging tahanan natin, kinalakihan ng ating mga anak, at nakasanayan nating tirahan. Huwag na nating hintayin pa na pati sarili nating mga anak ay mapariwara at matigil sa pag-aaral. Hindi pa huli ang lahat.
Sabay-sabay nating ipanawagan kay Pangulong Arroyo na huwag lagdaan ang panukalang rebokasyon ng Proklamasyon 704, at magsagawa muna ng konsultasyon sa mga lider at apektadong residente dito sa Lupang Arenda.
